India’s Wishy- Washy Laws

The Indian Law came into the effect on 26th January 1950 was largely “Copy Paste” of English Common Law which had been changed almost 100 years back but Our Legal System remains the very same. I still remember two phrases I wrote in my earlier blog for the Legal system in India:

1.      There is rule and there is Law but there is no rule of Law In India
2.      Justice prevails in only 2 conditions in India, One if you know the law and second if you know the law minister (strictly means power and is not personal remark).

The Indian Constitution was made flexible by the makers where it has been amended almost 94 times unlike USA which just got 27, their law being rude and rigid. There are many Problems that Changing India is facing which are untouched by our law yet. Thanks to our rotten politics with the sole ingredients of Minority and Caste appeasement which has left it Spineless. I remember that NDA led Govt. made an initiative to upgrade the law which was opposed by calling it REWRITTING the LAW, ANTI- AMBEDRKAR and hence, quite surprisingly ANTI – MINORITY.

There are various issues which need to be dealt with utmost priority but the internal mutiny for Vote Bank seems overpowering it since Independence:

1.      I feel surprised when I came to know that there is no Law existent in India for Sexual Exploitation of minor kids especially Males unlike Females(54% kids being exploited as per a survey). In case of Female, the Pervert is treated with rape charges but there is no mention for the Male Minor as if Constitution thinks that Minor Boys can’t be exploited.  

2.      Recently, I heard that my friend’s father died of Heart Attack in a train when he was coming back from his native village to Hyderabad. It is quite surprising that India railways being the 3rd largest Industry in World do not provide any Medical assistance in even Long Running Trains. Even stopping the Train would not have fetched anything for that South Indian heavy built tall man, Thanks to our Great Road Network and Health Facilities. Mumbai Local Train Carries Millions of People daily but it was the courage and Initiative of a Determined Man who lost his both legs in a Train accident to make the Govt. implement laws that Bound each Station to be equipped with Immediate First Aid facilities which If given to him would have save his legs.

3.      We generally hear from our Most Honest Police commenting that there are less Number of Rapes, Murders and Robbery though the unbiased surveys show completely different picture. It is because 6 out of 10 are only reported and FIR’ d  and hence there is no law which compels the Police to report even a complaint in their registers so that they are bound to reply to the Court.

4.      India is the leader in bringing Scrap from the World but there are no laws or codes for the Import of such scrapes and they mostly enter unchecked. The Recent fiasco in Delhi where radioactive Cobalt 60 was found in Scrap shows that how foolish a human can be. If the amount was even as big as a matchbox, the complete locality could have been under serious life threat. There are cases where live explosives and Missiles were found in scraps but still we are mere spectators to such Feeble Laws or rather the unwritten Laws.

5.      The Dowry Law- IPC 498A has become a Law for revenge which by and large observed by the Courts as being exploitation by the Bride’s house to sue Groom. It was written rightly to avoid domestic violence but this seems to have backtracked and the majority of cases filled under this are found fake and under motive to humiliate and avenge which has been termed as “Legal Terrorism”.

6.      There is no law to compensate for the loss and damage caused when the some Political group which resorts to violence in order to be heard (in the lights of Maharashtra’s fiasco on Movie – Marathi Manoos etc). There is no law to subside the Communal and Caste based Violence which has struck India even in 2010 ( recently in Bareilly)

7.      99% of Indians continuously abuse and refute the Politicians but on the Judgment Day we find our Lazy Beds and Couches more Comfortable and the Election Day is a day to celebrate Sleep with the Voting turnout to be marginal 44% in average. Duty and Right to Vote has been said endlessly but apart from “Gujarat” no other Indian state has come out with strict LAWS for Compulsory VOTE.


The above are just few cases that came across and there are many more loop-holes that still exist in our legal system and are known by only those who have passed through its tiresome journey. The People are Doing what actually the Government should do either by awareness Programs or by Scripting them in law. These feeble laws will prove to be catastrophic in near future as our growing demographic dividend will find easy to earn on these leaks in the system as been done in the case of Harshat Mehta and Ketan Parikh who turned out to be the eye openers for the Law Makers.

It is better to be safe and sound than to be sorry. The Britishers have time and again improved their constitution as per the growing need for the generation but It seems Indians take it hard to realize the Tragic Instances when More Stringent laws could have saved many lives and avoided atrocities on its People . There are already 2 crores cases pending and it seems that another case needs to filled for making social and judicial reforms which will end up being 2crore and one.

India is said to be a soft state but I wonder how long will the Society remain the Soft Society?

The Mother of Terrorism and Corruption in India

Dr. Kalam once rightly said that Poverty is the mother of all the violence and Anti – social activities in our country. India is known to be a POOR NATION but believe it or not, we are the RICHEST of them all. I feel deeply hurt observing millions of Beggars roaming on the streets. Mostly faking their disabilities or are forcefully made one. About 3 Crores of them are minors who have the right to be educated while others to be employed somewhere with respect to their skills but the fake promises of the rich Politicians haven’t fetched them anything yet. They have a Potential Energy for working more on less calorie intake if used wisely. If the genuine Development reforms are initiated today then in even next 50 years we won’t meet saturation thereby providing them handful of jobs.

I was shocked and petrified to read a Press Release of Our Home Secretary quoting that there is 40,000 Sq. Km land untouched by any Govt official for past 30 years. This is indeed the Mother of NAXALISM.  These areas might come out to be a kitty of rich fossil fuel as the Naxal Affected areas also have huge Natural Reserves in their womb. Now, out of this Below Poverty Line People (BPL), there can be another Dr. Kalam, Birla/Ambani, Bindra, Dr Bedi, Aamir & many others yet to be out of the closet. What they just lack is the Basic Education and Vocational Training.  We are going at an Educational System where in next 20 years we will have handful of jobs but hardly any Indian competent enough to grab it, like today most of the Airlines are being owned by Indian Nationals but The Top Management is being headed by a Foreigner. (I hope Mr Sibal continues his reforms to save the future). The excuse for all delay in these reforms is the fear of going bankrupt while implementing them but in the process we forget –



There is $1,456 Billion Illegal Money in Swiss bank itself. (Which is even more than combined illegal money of the World) There are few other banks that have not disclosed the figures but have almost same amount there too. There are The Great Jharkhand Robbers with more than 5000 crores grabbed and many more yet to be traced. Needless to say that there is colossal Mafia in Jharkhand, Chattisgarh, Vidharbha, Bellary and Bihar which have unlimited resources yet the common people are under BPL & committing suicides. It is attributed to be a scam of 65,000 Crores in TRAI distribution and the fake currency eats up 1, 69000 crores. If the reader himself calculates these rough figures with very vague references, we might get a GDP of more than 20-25% without Petrol hike and whooping 16 figures in hand. This can easily be diverted to construction of Road, Rails, Dams, Nuclear Enrichment Plants, R&D labs, Space stations and more missile launch sites near Borders to take the upper hand with China so that they come on the table to return Our Hijacked land rather being negotiating for more. Even China has planned to connect its cities with 70 Nations via Rail and Road but India has not yet produced any Multilane Highways (without a GUDDHA) to connect Indian cities itself. Most of Our International Borders are Underdeveloped which can be catastrophic or will claim more lives incase of war.


If All NHs are constructed like the Golden Corridors we might save Crores of Rupees wasted on Jams and can cut travel time by half reducing Congestion and Global Warming thereby saving The NATIONAL MONEY. The cold arid lands of Ladakh with -45*C is the last place on earth to produce Vegetables but with the sincere efforts of DRDO now Produces 5000 Tonnes an year. Earlier Rs 150/kg was spent to transport them from Chandigarh (nearest Base) which took 3 days to reach (thanks to the beautiful roads) Hence this money can be used to counter the donated F-16s to Pak with our manufactured ones (as being done by China 10 years back) which will be cheaper and according to our Requirements and Needs.  On a NANO car Rs. 35,000/- is wasted as twice it was stopped, then shifted and now Heavy taxes are imposed thereby BURNING A BIG DREAM INTO ASHES. The Incapability and unwillingness of the Politicians is the reason of the NATIONAL WASTAGE for which they should be Booked as it’s against the National Interest.

Giving higher pays to Lower Police and Army level can cut acute shortage and will reduce corruption thereby ending their Hand in Glove Coordination with Traffickers. The fake Currency can be uprooted within a month if RBI just stresses on Lower value notes as there is no Profit in replacing them with Fake ones. This will not only disconnect the racket but will kill corruption as the Bribe will be transported in Trucks.


If I summarize, I would say “INDIA IS THE RICHEST NATION STILL”. Our Population is our Strength and not a weakness. It just needs to be mobilized wisely and intelligently. The National Interest must be prioritized over Personal. We don’t claim our land that’s why Pakistan and China have. We don’t teach our Poor that is why they love Crime for easy money. Might be this blog seems humorous but I will love if someone finds sense in it. It might be the dream of few but it takes just a sincere effort to bring it to the reality.

PS: Some of the issues have been voiced by the People like Mr. Nandan Nilekani, Mr. Advani/Atal, Yog Guru Ram Dev, Dr. Bedi and many others who aren’t as popular as the formers. I have tried to join some of their pieces together.

The Trained Protectors Turned Spoilers of the Law

I am a firm believer that If Police wants then none can even dare to think about stealing a young boy’s toy on the Road. Whenever I have been to places outside Delhi, People tend to ask me if it’s Safe to be in Delhi and I find myself sitting at the edge of the knife because I am going to defend something I have not seen in recent times. Hence today, in my blog I would accept that yes if we rate Delhi Police it tops the chart of worst along with the lights of U.P, Bihar and Jharkhand. And yes we are talking about the State which will hold Commonwealth next year and most importantly is The Capital of India. The Police Commissioner Proudly says that last year they have reduced amount of RAPES, MURDERS, ROBBERY AND OTHER CRIMES, but he again & again forgets that these cases are those in which Police was made to forcefully lodge the FIR. There are uncountable cases where Police rather throw and kick the victim out of the Chowkis. The Police have only become the biggest “Gunda” of this country, from Hafta Wasooli to Threatening people; they have left no stone of difference unturned.   

Recently I came across a facts that young SCHOOL Boys and even Girls who are studying in so called Reputed English Medium Schools are busy snatching mobiles, bags etc on their unlicensed Bikes. The reason is they have lost all fear of the Law and its Protectors. There is an incident where I was going to the IGI Airport, on the way from CP to IGI, I could see Policemen at every 10 feet while returning I saw but obvious our PM going for his Russian Tour and as he passed each checkpoints, to my surprise I could see all those attentive Policemen suddenly roaming, talking and smoking in groups, again the whole traffic getting confused because all the three Signal Lights are “on” hence no one knows whose turn is it to cross. If this country realizes that the Police is made to protect the PEOPLE and not just the PM (who is in turn made by the People), we can beat the European Nations the very Next Day. Making the situation worst is our Constitution , we are still following that 200 years old UK law which they themselves have completely changed a century back but our makers are still Sleeping or were sleeping when they made it. The CRPC and The IPC completely need a makeover so that The Police is forced by the law to hear all the Victims and not the victimizer. I remember a time when these Policemen lathi charged HUNGRY AND PEACEFUL Protesting Intern Young Doctors (at the Reservation times) on the orders from their Legal Fathers. It was unfortunate that at that time there was not a single strong Student Leader who could make the Police bear the same pain which they were giving to innocent students. The Police can only control those who are defenseless while people like KASAB kick them up and down like anything.

There are two kinds of Justice in our country, the one who knows the law and the other who knows the Law Minister. In Delhi just the Police is not completely at fault. When they try to perform their Duties honestly the first person they catch is either “A Bureaucrat’s son or A MLA’s Son or A MP’s son or nevertheless have some contacts with various Policemen across Delhi” and he is our “legal Dammad” so there is no law written for him. Not only Police even the Judiciary has got many blood stains on their black Suits. Which are highlighted again and again by Media which I seem is the only strong Pillar of this Democracy and is somewhat less rusted by money. Not only the Police needs a makeover, the whole Judicial system needs to look an alternate Heading to deal with the situation. If the Law of the Land is Strong I cannot imagine that any criminal in this country can dare to laugh after being convicted.

I remember a lady called “Kiran Bedi” who completely changed the situation of TIHAR JAIL and now the prisoners that come out are human beings and not criminals or animals. She was the leading contender for the C.P of Delhi but again I guess my second Law of Justice made her to step down and take early retirement. I would at the end like to quote her sentence here “There is LAW and there is RULE but in India there is No RULE OF LAW”.

Human Rights and Its Activists

As we all know and as the name suggests this Commission or the set of people who are involved with this act or association was made to provide EQUAL RIGHTS TO ALL AND TO AVOID ANY VOILATION OF THE SAME. But I don’t really find this happening much at this juncture. Why do I always find the commission always standing at the confrontation with either the Police or the Military? It does not seem that it was made for the Human Rights but rather made for the Criminal Rights. There are thousands of the examples when the Criminals could escape the deathly punishments just because some activists intervened in the matter and tried to influence either the Police or the Court. Is this Human Rights just for those who commit act of Terrorism or this was made for the common man who die each day due to the Violation of its Rights.


Recently the Naxal Strike prompted me to write on this Topic which was in my mind from long time. I remember the MOST EDUCATED AND HIGH PROFILE ACTIVISTS CLAIMING THAT THE WRONG IS BEEN DONE TO THOSE NAXALS AND THERE DEMANDS SHOULD BE HEARD. They kidnapped a Cop so that they could free their leader who was caught in Delhi and is now been put to Trial which obviously, the Naxals don’t like. Putting oil to fire these activists came strongly for their defense stating that there need to be some peaceful way out and the killing of these Naxal (which I suppose are The Domestic Taliban) should be stopped. Now today i.e. on 6 October 2009 these same Naxals,  Brutally have Chopped the Head of that Innocent Cop and his dead body lies in front of his family demanding the justice, why are all these Idiot Activists are sitting on their couches silently? WAS THE COP HUMAN OR NOT? DID THE COPS ALSO HAVE THE SAME RIGHT TO LIVE? Now where is commission and why don’t they come forward to talk against these Naxals. Why the Human Rights is always Targeted against our innocent cops who lay down their life for us.  This is the very latest incident that happened but it is not the first time. In the Batla House Encounter in Delhi, I remember the same Commission stood against and called it fake. But if it was fake then how our most Efficient and Daredevil Cop/Encounter Specialist died on the spot. Now where are the Rights for this BRAVE SOUL who left behind his 80 years old Father, wife and a Teenage old son?  The old father still roams around door to door to get the rewards from the Ministers which were flamboyantly promised. When each day the Farmer of this country opt for suicide does this Big Babus walked for the Rights of Those Innocent Poor people. When there are massive floods and the Government as usual is helpless and incompetent to deal with the situation leaving thousand of people stranded at the most remotest part of this country, why don’t these activists come out and help those people? Why is a Bastard Terrorist in any way supported by these people? What about those innocent people who died? Did any time these people try to see the situation of our Border Security Forces who don’t have even the Proper shoes to walk on the Icy Siachin Glacier and they have inadequate oxygen Cylinders at the Highest Border shared with either China or Pakistan? I think these acts make you feel that rather than working for this nation these activists are against the National Interest of this Country.



I think the country should themselves decide if they really need these PUBLICITY HUNGRY CREATURES or they want SOCIAL WORKERS who work in fair and proper manner for the people of this land. They should help the Police and Military to wash out all those who are against our People and are Security threat to all the citizen of this country who have paid there hard earned money in the form of tax to this Government in order for their safety and security. Do not let your wealth go in drain by obstructing the Path of the Government and the Armed Personnel and don’t make anymore cross Roads for them which may rather lead to more causalities at the end of the battle. The common man needs this Commission for his interest but this can only be done if every matter is dealt with a certain sense of Responsibility and not taken for granted to publicize everything that is done to sustain the Integrity and the Democracy of this country.

THE MEDIA

The media is the mirror of the youth of that country, but when the mirror is spoiling the young minds, I think then it needs to be either Replaced or Censored. When I say media it does not only relate to the News Channels (Print and Electronic) but also the daily soaps and reality TV which is hardly any reality. I feel really pained when these greatest influencing modes of Communications have just become a puppet dancing for Ads and TRPs.

First is the News Channels: Many a times after watching the news I realize that after some time they themselves backtrack there previous report saying it was from their sources and now they have got a different verified reports which is opposite of what they were crying on and then takes the full credit for this change. If some one does something it’s a matter for cry and if nothing is done then ofcorse it a matter to be reported. Does these dual stands of media making any sense? Is this what they call responsible Journalism?  A sensitive matter such a Kandhahar Hijack is pulled out of proportion even after so many years, does anyone report how the passengers and the cabinet ministers (who took decisions for them) felt at that point. I am sure they had sleepless nights. In Delhi at Batla House there was an encountered where we lost our very best encounter specialist, a politician came out saying it was fake and then out of generosity gave a cheque to his family but have those news channels reported that the same cheque bounced, as the figure mention in words were different to that mentioned in numerical. News channels try to defend a terrorist but they have never shown the cry of our armed forces who walk without proper shoes in the Siachin Glacier defending our borders. Sanjay Dutt was shown a relieved man but what about those who lost there life in the Mumbai Blast. He was shown wearing a lucky shirt but none showed the tears of those who got the shrapnel in their chests. They make Sachin, the God of cricket one day and the same man is asked for his retirement when he was bowled out for duck on the other day. They have got a magic wand which can change the life of people within hours. Today every month almost 80 farmers’ suicides do not make any sensible news but Priyanka Chopra goes for a blood sample check makes the highlight story.

These ridiculous behaviors of the media is been rather used by the anti groups to make their task easy. The terrorists are not being hanged just because HUMAN RIGHTS COMMISSION wants publicity so there is debate in media about banning death penalties. Most of the Channels I found are biased towards a certain community or a party because doing so gives them high TRPs. Some clever minds use the media as a tool to get their work done & it is surprising that news also state that it is done for the publicity. Due to this carelessness many important issues that deserved a proper media attraction are left untouched.


The reality TV has found a rather easy way to get popularity. It now uses show of skin to attract attention. The more vulgar the show is the better profit it makes. Most of the shows today aired are scripted so that they can either induce the acts of vulgarity or can promote the double meaning talks. The growing rapes, murders on pity things, robbery are the definite result of these. Most of our population is either unemployed or uneducated hence these things make an easy bad impression on their minds, they take reel as real. Thousands of families are ruined because of the pathetic, out of real world serials which are actually making the people confused about their lives. In this country when some FANs opt for suicides just because their favourite Actor or Leader died, it clearly shows that these channels really make a great impressions of their minds.

I don’t know what method can stop this, the one used by Hitler or the one by Stalin but for sure there need to be some rationalization and scrutiny on what is right and what is wrong. There need to be a law that can check on the reality of the news and shows aired. They should have a certain proof of what they show so that some rumor does not take the shape of fire, it should not create panic and hatred in the minds of people as at the end of the day it is the common man who has to face the consequences. It does not in any way mean that I am against Democracy but I stand for not fancying your rights on someone else’s expense. Our right ends the very moment when other person’s right begins. I also appreciate the work media does. The biggest power in the world today is of the pen. There have been great changes when people started penning down their thoughts. Media has the biggest responsibility of changing this world and to make it a better place to live in, hence, which they should understand and should not force their thoughts on the people. Their work should not be just confined to criticize everything that happens around; they have no right to downplay some one without knowing the truth, as there is always the OTHER SIDE.
